The offer and
sale of goods via web site
www.caffecreme.it and the Customer Service on
+39.080.9147136 are subject to the following General Sales Conditions. These
General Sales Conditions have been established in compliance with the law
regulating contracts concluded outside the commercial premises and, in
particular, pursuant what has been established by the Legislative Decree n°206
of 06/09/2005, (Consumer Code).
Parties to the contract
The parties
to the contract are the following ones:
- Caffè Crème:
Pachi S.r.l., based in Modugno, Via Dei Bucaneve M/3, Register of Companies of
the Chamber of Commerce of Bari, Tax Code and VAT number: 05733060726.
- Customer: the end user, that is, the natural
person who is acting outside the scope of an economic and professional
activity, identified via web site www.caffecreme.it
or telephone call, and who has placed an order accepted by Caffè Crème.
Implementation and change of the General Sale Conditions
By placing an
order through the provided methods, it is deemed that the Customer has read all
the information given during the acquiring process and fully agrees to these
General Sale Conditions.
Caffè Crème reserves
the right to change the General Sale Conditions by giving information in this
web site page. The applicable General Sale Conditions are those valid on the
day that the order was placed.
Each change
will be effective after its publication on the web site.
Sign in
Signing in
with username and password is facultative.
If the
Customer doesn’t wish to sign in, he can still conclude a purchase: he will
only be asked to provide the data needed to realize the delivery and the
possible invoicing of an order.
Characteristics and prices of goods and services
The pictures
of the goods may be not perfectly representative of their characteristics and
be different in color, size, optional products that are shown.
All the given
information to make the purchase must be intended as a mere general information
material that cannot be attributable to the real characteristics of a single
good.
Goods are
offered with the price indicated on the web site on the day in which an order
was placed.
The coffee
goods are removed from the sale 3 months before the expiry date. The prices
include the VAT number which will be indicated in detail in the purchase
invoice of the good, if issued.
Prices do not
include freight and delivery costs which are indicated in the last part of the procedure
before sending an order and specified in the confirmation email of the received
order sent to the Customer.
Placement of orders
Orders can be
placed only from and to the following countries: Italy, the Republic of San
Marino, Vatican City. Orders are subject to quantity limits (minimum or
maximum) and goods are offered according to the stock availability limits.
If existing,
promotional codes proposed by Caffè Crème are exclusively valid for the goods
and the period which are specified each time. Promotional codes are not
refundable and they are not cumulable.
To make use of discounts and/or special offers
linked to promotional codes, you need to enter the promotional code in the
right space when confirming an order on the web site. In case you forget to do
so, an order cannot be canceled or renewed to use the promotional code.
Orders coming
from under 18 subjects will not be accepted.
The steps to
place an order and conclude the purchase contract are clearly underlined in the
sequence of the web site pages by means of explicative texts and graphics.
Possible
mistakes in the provided data can be corrected before sending an order.
Received order confirmation and acceptance.
After
receiving an order, Caffè Crème shall send an email confirmation including all the
details.
After
receiving an order, Caffè Crème shall verify the availability of the ordered
good and, only after verifying that, it shall accept the order and ship the
good.
If Caffè
Crème is not able to issue an order that has been received, this will be
shortly noticed to the Customer.
Each right of
the customer to be entitled to damages or compensation, as well as to any
contractual or extra-contractual responsibility for direct or indirect damages
to people and/or things caused by the denial of an order in not contemplated.
Accepted payment methods
Caffè Crème
accepts the payment made only through the following methods:
- Credit
Card
In the cases
of goods purchased by credit card (immediately after the conclusion of the
order transaction), the correspondent bank will authorize the charge of only
the amount concerning the purchase that has been realized.In case of an order
cancelled by the Customer or if Caffè Crème does not accept the contract, Caffè
Crème will request the cancellation of the transaction and the transfer of the
paid amount. Clearance times exclusively depend on the bank system and can go
up to their expected deadline (usually 24-25 days from the authorization
day). After realizing the cancellation of the
transaction, Caffè Crème cannot be held responsible for any delay and/or damage
caused by the bank system at all. Caffè Crème reserves the right to request
further information or the copy of documents showing the ownership of the card
which has been used by the customer. If the Customer does not provide such
information and/or copies, Caffè Crème reserves the right not to accept the
conclusion of an order. During the purchase process via credit card Caffè Crème
shall never have access to the personal information concerning the owner of the
same card since the information is directly transferred to the bank managing
the transaction and using a protected web site. For this reason, Caffè Crème cannot
be held liable for any
fraudulent or illegal use of
credit cards by third parts during the payment process of goods purchased on
the web site. The credit cards that are accepted are Visa, MasterCard,
American Express and Diners. In order to guarantee the maximum safety in
payments, online transactions by credit card used to pay the purchase of your
goods on Caffè Crème web site are realized by means of a safe Server that uses
the SSL (Secure Socket Layer) system. This system is able to encrypt the
entered information so that their interception by external users is impossible.
When you are paying your order by credit card, Caffè Crème automatically sends
you to a safe page (SSL) of the web site of the bank managing the transaction.
In this page you can enter the data of your card (number and expiry date) in an
extremely safe way. Indeed, data are directly transferred to the Bank, offering
you the best warranty. Differently from what happens in a traditional
commercial activity where the data of your credit card pass under the look of
the owner, the employer or the waiter, online transaction becomes absolutely
safe because nobody, neither Caffè Crème, can have access to the codes of the Credit
Cards used by customers. The code is used only during the payment process. If
the payment ends well, the confirmation is immediate and Caffè Crème only
receives a confirmation email of the transaction from the Bank. No trace of the
code of the Credit Card is left in any of our archives. You can verify if you
are safely operating in different ways:
· by
receiving a text message by your web program;
· by checking
if the address of the web page you are in is proceeded by Https;
· by checking
the symbol appearing below at the left or right part of the web page window: if
you see a whole key or a closed padlock, then, SSL is on.
- Anticipated
bank transfer By selecting
the anticipated bank transfer payment, the shipment of the ordered goods will
be realized only when the amount of money will be effectively credited to the
account of Caffè Crème. The credit has to be realized within the 7 working days
from the day on which the order has been made on pain of cancelling the order. In
the bank transfer, the reason for payment must include:
· the
reference number of the order
· the date of
the order
· name and
surname of the holder of the order.
Shipment of goods
Shipment and
delivery of goods can be exclusively realized in the countries of Italy, the
Republic of San Marino and Vatican City. Caffè Crème shall realize the shipment
of goods exclusively to the address that has been provided in an order.
Shipments to PO boxes are not allowed.
Caffè Crème shall
realize the shipment of the products ordered by the Customer, by means of
carrier, to the same given address within approximately 48 working hours from
the day on which the order has been confirmed. The delivery is usually realized
within 6 working days. The estimated delivery
time of goods is only indicative.
Delivery
costs are invoiced according to the fees reported on the web site or notified
by the Customer Service the date on which the order has been transferred.
The carrier
of the goods is liable for the payment of taxes and customs duty established by
the regulations in force in the destination country of the goods.
The carrier
is in charge of the delivery. Caffè Crème shall gather all the possible notes
of delayed or failed delivery of goods through the Customer Service and, if
this is the case, shall help safeguard the rights of Customers as established
by the law.
Acceptance of the good by the customer
Any damages
to the package and/or the good or the failed correspondence of the number of
packages or indications must be immediately notified by reporting a specific
note on the delivery document. By signing the document of the carrier, the
Customer confirms the effective external integrity of the good and the compliance
at the delivery.
Any problems
regarding the effective physical integrity, the correspondence or the
completeness of the goods that have been received must be notified within 10
working days from the day of the delivery by writing an email at clientservice@caffecreme.it
or calling the number +39.0809147136.
Invoicing
An invoice
will be issued for each order made by the private Customer who has entered the
tax code and for each order made by the professional Customer or company having
the VAT number. The information provided by the Customer while placing an order
is used to issue the invoice. No modification in the invoice is allowed after issuing
it. While placing the order, indicating if the shipping address is different
from the billing address is needed. If the private Customer chooses not enter
the tax code, or the Professional Customer or company does not enter the Vat
number, Caffè Crème will neither issue any invoice nor attest the payment by
means of a receipt or official receipt (section 22, paragraph 1 DPR 633/72 and paragraph
2, letters oo) DPR 696/96) ”
Right of withdrawal and return policy
In executing
what has been established by the Legislative Decree of the 21/02/2014, n.21 implementing
the directive 2011/83/UE on consumer rights, the Customer can return the
purchased good and obtain the reimbursement of all the payments effectively
received.
The Customer
has the right to withdraw from this contract within 14 days from the day on
which the good has been received following these instructions:
1. Before the
above-mentioned withdrawal deadline, the Customer must send a recorded-delivery
letter with advice of receipt to Caffè Crème or a communication concerning the
exercise of the right of withdrawal. The communication can be sent, before the
same deadline, by telegram or phone call to the Customer Service +39.0809147136.
2. The
Customer Service contacts the Customer giving the Authorized Withdrawal Number (AWN).
3. The
Customer writes down the AWN number on the model withdrawal form received
together with the delivery documents.
4. The
Customer is then contacted by the carrier who will take charge of the
withdrawal.
The
withdrawal of the good must take place before the deadline of 14 days from the
day on which the AWN has been received.
The
reimbursement of the amount paid to acquire the good includes the cost of
delivery.
Caffè Crème
shall reimburse the purchase amount but the Customer will be liable for any
diminished value of the goods resulting from the handling other than what is
necessary to establish the nature, characteristics and functioning of the goods
(for example: damaged, not regularly or not completely packaged goods, in case
of lack or damages of specific parts, like components, elements, accessories,
packaging material, boxes, documents and/or other items). If the Customer sends
back the goods outside the deadline or if the product and the packaging are no
longer in their original, complete, undamaged and unused state being not in
conditions to be returned, the right of withdrawal cannot be exercised and Caffè
Crème shall send back the purchased good to the Customer who will be liable of
the shipping cost.
With the
exception of any possible cost resulting from fixing verified damages of
the original package, Caffè Crème shall reimburse all the payment already
received to the Customer within 14 days from the day on which the good has been
delivered back, by cancellation of the same amount charged on the Credit Card
or by bank transfer. In the latter case, the Customer shall rapidly provide the
bank coordinates on which the reimbursement has to be made (complete IBAN of
the current account of the holder of the invoice).
Warranty
All the
goods, except for edibles, sold by Caffè Crème are under conventional warranty
of the producer and under a 24-months warranty for compliance defects as
established by the Legislative Decree 24/2002 and its modifications and the
sections 130 and 132 of the Legislative Decree 206/2005. The Customer shall
keep the invoice or, if not existent, the shipping document to be entitled to
use the warranty assistance.
If the
acquired good has some manufacturing defects and/or damages resulting from the
shipment, the Customer can ask to replace the good within the peremptory
deadline of 10 days from the day on which it has been received by telegram or
email at clientservice@caffecreme.it or calling the Customer Service number +39.0809147136.
The Customer shall also return the faulty or damaged product in its original
package complete of all its parts.
In case of
returning the good, Caffè Crème is liable for the shipping cost. Caffè Crème shall,
then, replace the good with the same product as the original one or, in case of
sale of all stock and prior agreement with the Customer, with a product of the
same value.
Regulations in force and competent court
The
sale of products and/or services takes place in the country of Italy and it
undergoes the regulations in force in the Italian Republic. The competent court
to solve any controversy shall be the one foreseen by the Italian regulations
in force when completing the contract.
